Montenegro
has got 240.000 beds in all types of accommodation. Of that 26.000 is
in hotels and tourist villages, 20.000 beds in camping sites, 18.000
in rest homes, and the rest in private accommodation.
Registration
in the name of the new owner takes up to three months from conclusion
of the sales contract during which time the new owner can take possession
of the property.
If
the buyer wants a property he simply pays for it at the same time as
he signs a full sales contract with the owner(s) and that's that. Alternatively
he can pay a deposit, wait a month or so and then pay the rest. It depends
on his agreement with the owner(s).
The
purchaser will have to give a copy of his passport to the lawyer together
with power of attorney for the lawyer to do the conveyance on his behalf.
This is quite normal but a standard precaution is to check that the
power of attorney is for conveyance and he's not inadvertently giving
permission for the lawyer to do something else.
This is a discrepancy in the law that will be ironed out in early 2006
when foreigners will be able to buy anything they want anywhere they
want.
The
alternative for the time being with houses with land plots over 500
sq m is to open a company. This is a fairly simple process and can be
done mostly by power of attorney but it's best to make sure a good lawyer
is engaged to take care of everything.
A
company can be opened by a lawyer for around 500 EUR
Bookkeeping
costs for preparation of company accounts are around 100 EURO per month.
Legal
fees for title checking and conveyance are around 500 EURO.
Real
estate transfer tax payable to the government by the purchaser is calculated
at 2% of the value of the property.
Unlike
Croatia there is no requirement to wait for permission from any government
ministry in order to purchase directly as a foreigner or via a company.
